AI MUSIC LAWSUITS PRESS FORWARD FOLLOWING ORAL ARGUMENT

Following recent oral arguments in one of the music industry’s most closely watched AI copyright cases, counsel for independent artists is emphasizing a core legal principle at the center of the dispute.

The statement, delivered by Krystle Delgado, entertainment attorney and recording artist known as Miss Krystle, cites Universal Studios Inc. v. Corley and emphasizes the plaintiffs’ position that the use of copyrighted works to train generative AI systems without consent constitutes unlawful taking.
Things are looking good for independent artists in the Udio case, with the Court denying Udio’s motion to dismiss the major record labels’ DMCA claim (which is also being asserted by independent artists) as of April 15, 2026. Udio attempted to characterize itself as a neutral platform and even went on to blame its users for any alleged copyright infringement in court filings.
Delgado serves as lead counsel in class action lawsuits against AI music platforms Suno and Udio. While the court has not yet issued a decision following oral argument, the litigation remains ongoing. The primary copyright infringement claim against Suno continues to stand and is not being challenged.
The cases are widely viewed as a defining legal test of how copyright law applies to generative AI, particularly as it relates to training data sourced from existing music.
The cases have drawn attention across the music industry, with support from major organizations such as BMI and thousands of independent artists. At stake is whether creators will maintain control, consent, and compensation as AI continues to reshape how music is made.
